The European Digital Innovation Hubs (EDIH) Summit 2026 in Brussels offered a comprehensive overview of Europe’s best practices in the field of AI regulatory sandboxes. One of the most important observations concerned the growing role of sandboxes in supporting companies, SMEs, public sector institutions and ecosystem stakeholders, so that the European AI Act can actually be implemented in practice.<\/h2>\n

The purpose of AI regulatory sandboxes is to help AI providers (as defined in the AI Act) better understand the legal frameworks of the European Union and its member states, and to develop safe and trustworthy AI systems. They also provide practical input for shaping future legislation. Testing in a safe and supervised environment reduces the risk of AI systems failing to meet safety requirements, and thereby supports responsible innovation. In addition, sandboxes help build trust in AI technologies and attract investment into trustworthy technologies (European Commission, AI regulatory sandboxes<\/a>).<\/p>\n

The EU AI Act, Regulation (EU) 2024\/1689 of the European Parliament and of the Council, establishes harmonised rules for AI and applies from 2 August 2026 (editor’s note: the application of the provisions concerning sandboxes has been postponed to 2 August 2027). The purpose of the regulation is to ensure that AI systems placed on the EU market are safe, trustworthy and respect fundamental rights. The regulation also strengthens the internal market and promotes innovation among institutions and companies, while protecting the health, safety, democracy and rule of law of European citizens (AI Act<\/a>).<\/p>\n

In an AI regulatory sandbox, developers can safely test and develop AI systems in cooperation with national competent authorities (in Estonia, for example, TTJA, AKI, RIA and other sectoral supervisory authorities). The sandbox service includes regulatory validation, technical assessment, support for data governance and fundamental rights impact assessment, and where needed access to high-performance computing resources.<\/p>\n

The developer receives clear and documented feedback on the legal, technical and data protection questions relating to their solution, which reduces the provider’s risks and increases trust in the eyes of investors, clients and supervisory authorities. At the same time, the practical capacity of supervisory authorities to assess AI systems and exercise oversight over them grows stronger. This mutual learning between companies and supervisory authorities lays the foundation for responsible innovation and for the growth of European competitiveness.<\/p>\n

AI Regulatory Sandboxes: the Estonian example<\/strong><\/h4>\n

Among the cases discussed at the EDIH Summit, particular interest was drawn to Estonia’s experience, where the AI regulatory sandbox has already begun testing the operations with real clients under the leadership of the Ministry of Justice and Digital Affairs.<\/p>\n

As Evelin Ebruk noted: “Estonia already has the preconditions in place to start thinking about how to apply AI systems to the state’s digitised processes. It is precisely because of such preconditions that the sandbox has been soft-launched early, so that the cooperation between the key stakeholders can be tested during the pilot phase.”<\/p>\n

The early launch of Estonia’s regulatory sandbox illustrates why AI sandboxes should be accessible across the entire European Union and why every member state must have at least one national sandbox (editor’s note: Article 57 of the AI Act obliges each member state to establish at least one AI regulatory sandbox at the national level). Estonia also emphasises the importance of sharing best practices between countries and stakeholders connected to critical infrastructure. The European Commission actively supports the launch of pilot projects even before the formal designation of competent authorities.<\/p>\n

Sandboxes help improve interagency cooperation and coordination, gather the resources and stakeholders needed for safe AI systems at an early stage, and support a consistent transition to the safe deployment of AI across Europe.<\/p>\n

Evelin Ebruk also described the internal division of labour among Estonia’s stakeholders: “Cooperation between Estonia’s stakeholders has been substantive and marked by a clear division of labour. AIRE supports private sector applications, while the ministry focuses on public sector applications.”<\/p>\n

This is an important lesson for other countries. Estonia’s example shows that European Digital Innovation Hubs play a key role in translating regulatory language into practical guidance for businesses. They also help developers navigate the application process more easily and efficiently.<\/p>\n

Clear conditions and accessible participation<\/strong><\/h4>\n

The eligibility criteria for a regulatory sandbox must be transparent and easy to understand. When selecting participants, regulatory sandboxes across Europe must assess whether the applicant meets the selection criteria. These include an understanding of what regulatory or practical questions the AI system seeking access raises, how mature and competitive the solution is, and how much the case can contribute to regulatory learning.<\/p>\n

SMEs have preferential access to regulatory sandboxes if they meet the assessment criteria and the company’s registered address or branch is located in the European Union. Regulatory sandboxes may also prioritise specific fields each year, particularly those that are strategically important to the member state or that face the greatest regulatory challenges (EU: Implementing Regulation on AI Regulatory Sandboxes, 2025<\/a>).<\/p>\n

Building a stronger AI infrastructure<\/strong><\/h4>\n

The aim of European Digital Innovation Hubs is to deepen cooperation with AI infrastructure stakeholders, including Testing and Experimentation Facilities (Testing and Experimentation Facilities<\/a>, TEFs) and AI factories providing AI computing resources (AI Factories<\/a>). Work is also under way to better harmonise the services offered across Europe and to reduce cross-border duplication.<\/p>\n

Every AI regulatory sandbox must have a clear plan setting out its objectives, the support provided in the sandbox and the resources available to participants. Testing in real-world conditions may take place within the sandbox provided that it does not conflict with other EU or national rules governing such experiments. Where high-risk AI systems are integrated into regulated products, the relevant sectoral national supervisory authorities must also be involved (EU: Implementing Regulation on AI Regulatory Sandboxes, 2025<\/a>).<\/p>\n

Evelin Ebruk added: “The first test cases take quite a time, especially when the aim is to understand how to make the sandbox process as efficient as possible between the different stakeholders.”<\/p>\n

This is an important observation: in the AI regulatory sandbox, the stakeholders learn together how to approach regulation in a way that is understandable, practical and, above all, supportive of innovation.<\/p>\n

For the author (Pirita Iham\u00e4ki PhD., M.Sc.), one of the most important lessons from the EDIH Summit 2026 was that AI regulatory sandboxes can become a bridge between regulation and real-world innovation. Estonia’s example already shows that this kind of cooperation between institutions and companies has been started early. The next step is to share best practices across borders and to support AI testing at a broader scale.<\/p>\n

AI regulatory sandboxes help Europe build a trustworthy, competitive and innovation-friendly AI environment.<\/p>\n
